Boese v. Cirrus Design Corp., et al., No. LAC0997958 (Dist. Iowa Marion Cty.)

Devers Miska Law successfully defeated the personal jurisdiction challenges by Hartzell Engine Technologies, LLC and Tornado Alley Turbo, Inc. to the jurisdiction of the Iowa District Court for claims brought by the surviving family of those who perished in a Cirrus accident. After jurisdictional discovery was conducted and extensive briefing, the Court found that both challenging defendants had sufficient minimum contacts to support the exercise of personal jurisdiction over them, and such an exercise would comport with fair play and substantial justice. Bocker, et al. v. Textron Aviation, Inc., No. 2021-53475 (N.Y. Supreme Ct. Dutchess Cty.)

On behalf of the Bocker family, victims of an aircraft crash into their home, Devers Miska Law successfully defeated Textron Aviation, Inc.’s challenge to personal jurisdiction in New York. After pervasive discovery, Devers Miska Law demonstrated that Textron Aviation, Inc. had a pervasive presence in New York which satisfied the New York Long Arm Statute and the requirements for personal jurisdiction under Ford Motor Co. v. Montana Eighth Jud. Dist. Ct ., 592 U.S. 351 (2021). This decision allowed the case to proceed on its merits. Read the decision of the New York Supreme Court here.

Bocker, et al. v. Continental Aerospace, Inc., No. 2021-53475 (N.Y. Supreme Ct. Dutchess Cty.)

Cohen v. Continental Motors, Inc., 2021-NCCOA-449

Mike Miska successfully argued an appeal before the Court of Appeals in North Carolina, and achieved a reversal of the trial court’s order granting a challenge to personal jurisdiction raised by Continental Motors, Inc. This decision was then upheld by the Supreme Court of North Carolina. Read the opinions here.
